Texas House debates abortion limits before vote

AUSTIN, Texas (AP) ? The Texas House began debating a bill on Tuesday that would impose tough new restrictions on abortions, as national activists on both sides of the issue descended on the Capitol building.

Republican Rep. Jody Laubenberg, of Parker, outlined the bill that would require doctors to have admitting privileges at nearby hospitals, only allow abortions in surgical centers, dictate when abortion pills are taken and ban abortions after 20 weeks. Exceptions to the ban would only be allowed when the women's life was in imminent danger.

Democrats and women's rights activists have protested the bill for weeks. The measure failed during the regular session when it failed to win enough support, then died in the first special session due to a 13-hour filibuster by state Sen. Wendy Davis, a Fort Worth Democrat.

Now Republican leaders including Gov. Rick Perry and Lt. Gov. David Dewhurst are intent on passing it quickly through the Republican-controlled Legislature in a second special session. Democrats can do little but slow the bill down, attract as much attention as possible and lay the groundwork for a federal lawsuit to block it once if becomes law.

Davis' successful filibuster put Texas' bill in the spotlight of the national abortion debate, and prominent figures from both sides have been coming to Austin and staging rallies. On Monday night, former Arkansas Gov. Mike Huckabee spoke to abortion rights opponents. The Planned Parenthood Federation of America announced a statewide bus tour Tuesday morning, called Stand With Texas Women.

"It seems like every time women looked up from doing their laundry of helping children with their homework, the Texas Legislature is right there taking aim at them again," said Cecile Richards, president of Planned Parenthood Federation of America. "Over the past few years, more than 50 women's health centers have been shut down."

Women from both parties who support abortion rights introduced a series of amendments to water down House Bill 2, hanging coat hangers on the front podium to symbolize illegal abortions, which they say will become more common if the law is passed. Rep. Senfronia Thompson, D-Houston, called for an exception to the 20-week ban in cases of rape and incest, but Laubenberg rejected the proposal.

Supporters of the restrictions insist that they will improve the health care women receive by placing more stringent conditions on abortions. Laubenberg told the House on Tuesday that her bill would ensure that women get high-quality treatment while protecting "babies" after 20 weeks of gestation.

"What we're talking about today truly is about the health and safety of a woman who would undergo an abortion, but also, I want to point out, we are talking about an unborn child," she said.

Federal courts have ruled that states can regulate abortions, but not to the extent to make them impossible to obtain. That hasn't stopped Republican-led legislatures in Texas and several other states from passing laws in recent years that test the legal limits.

Opponents of the Texas restrictions say they would effectively ban abortion in much of the nation's second most-populous state causing the closure of 37 of its 42 abortion clinics.

They also say the Texas restrictions and those passed by other states conflict with the U.S. Supreme Court's 1976 Roe v. Wade decision, which established that a woman has the right to get an abortion until her fetus could viably survive outside of the womb, which is generally at 22 to 24 weeks of the pregnancy.

It's unclear if the Texas restrictions could survive a court challenge. Federal courts have suspended aspects of the bill passed by other states. On Monday, a federal judge blocked enforcement of a Wisconsin abortion law requiring admitting privileges.

The Texas Medical Association, the Texas Hospital Association and the American College of Obstetrics and Gynecology oppose the bill, calling it unnecessary.

OBAMACARE END-RUN? GOP Challenges Power to Delay, 'Ignore' Mandate

House Republicans are escalating their scrutiny of the decision to delay a key part of the health care overhaul, questioning whether the Obama administration even has the authority to "ignore the law" without the approval of Congress.?

The administration announced early last week that it was delaying by one year a requirement that large employers offer access to health insurance. Officials described the delay as a common-sense concession to businesses who complained the rules were too onerous, and maintained the Treasury Department was within its right. ?

A Treasury official told FoxNews.com that the move was "an exercise of the administrative authority" under the IRS code. The official said the department has "longstanding" authority to "grant transition relief when implementing new legislation" like the health care law.?

A number of Republicans pointed to the sudden change as a sign of problems to come with the massive health care law. But, as lawmakers return on Monday from the holiday break, they're also challenging whether the tweak was an abuse of power.?

"This action raises a lot of questions about whether the Obama administration can simply ignore the law when it's convenient for them," Rep. Phil Roe, R-Tenn., said in a statement.?

He said he's asked the Congressional Research Service to "investigate" that issue -- "because I don't think any president has the authority to pick and choose what parts of law to follow."?

The matter will get an airing on Capitol Hill later this week. Rep. Kevin Brady, R-Texas, chairman of a House Ways and Means subcommittee, has set a hearing for July 10 which, in part, will examine the issue of the administration's authority to change the law.?

Rep. Darrell Issa, R-Calif., chairman of the House Oversight and Government Reform Committee, went a step further, describing the move as "another in a string of extra legal actions taken" by the Obama administration.?

The complaint about the administration's authority is just one of several Republicans have regarding the move to delay the mandate. They question whether more delays and changes are in store in the run-up to the Jan. 1 launch of many of the law's major provisions. They question why the so-called individual mandate -- the requirement on individuals to buy health insurance -- wasn't also delayed.?

But the Treasury Department and White House, in announcing the delay last week, explained that they did so after businesses complained about the reporting requirements. As the administration moves to simplify the rules, they said, they would in turn give businesses more time to comply.?

"We have heard concerns about the complexity of the requirements and the need for more time to implement them effectively. We recognize that the vast majority of businesses that will need to do this reporting already provide health insurance to their workers, and we want to make sure it is easy for others to do so," Mark J. Mazur, the assistant secretary for Tax Policy at the Department of the Treasury, said last week on the Treasury blog.

Elvis is in the building ? well a strand of his hair to be exact.?Tucked away on an antique stall in Oswestry, trader, John Perrins has an authentic piece of the King?s famous jet black hair.

The memoribilia collector was ?All Shook Up? when he made the find while living in America.

Now he has put the bizarre souvenir up for sale on his stall in the Cambrian House Emporium in Oswestry.

Mr Perrins, 68, lived in America for many years but had to return to Shropshire when he lost his home during a hurricane in central Florida in 2005.

He, his wife Linda, son Joe, and the family?s dogs, survived the hurricane by hiding in their ?walk-in? wardrobe that was directly behind the stone chimney. But the house was badly damaged.

?It happened so quickly in the middle of the night. But I remembered that when you see photos of hurricane-hit homes it is always the stone chimneys that are still standing.?

He said that with the damage to the house and his deteriorating health the family had no choice but to return to Oswestry.

He happened upon the strand of hair when he visited Memphis during the family?s two years in America.

?I bought the piece of Elvis?s hair from his barber and it came with a certificate of authenticity. I couldnt resist it.?

Barber Homer Gill Gilleland toured with Elvis for more than 20 years.

He dyed the singer?s hair black and then cut it, saving strands in a towel which he sold after the singer?s death in 1977.

He was also said to be the inventor of the famous black dye he used on Elvis. He died in 1995.

Mr Perrins said he set up a stall in Oswestry to help the family to move on with their lives.

?We had to downsize and so we had to get rid of some of our collection.

We have lots of American trivia from Homer Simpson items, Beanie toys and all kinds of interesting things.?

The piece of hair caught the attention of antiques expert, Helen Hall from the BBC Antiques Road trip when she visited the emporium this week.

Her show will be broadcast in the new year.

Daryl Kerr from the emporium said Mr Perrins? memorabilia was just one of the gems in the historic building, which has more than 30 stalls.
